1. Definitions and Interpretation

1.1 Definitions

For the purposes of these Terms and Conditions, unless the context indicates otherwise, the following words and expressions shall have the meanings assigned below.

Account

Means the registered user profile created by a Participant on the RAFFLE-it Website which allows the Participant to purchase Entries, view Competition history and manage personal information.

Competition

Means any raffle, competition, promotional draw or prize opportunity conducted by RAFFLE-it through the Website.

Competition Platform

Means the software, plugin or digital system used by RAFFLE-it to manage Competitions, allocate Ticket Numbers, record Entries and conduct random prize selections.

Conditional Competition

Means a Competition where the advertised primary Prize is subject to a minimum Entry requirement and where an alternative Prize may apply if the stated requirement is not achieved.

Draw Date

Means the date and time advertised by RAFFLE-it on which the Competition winner(s) will be selected.

Entry

Means a valid paid participation opportunity purchased by a Participant in a Competition.

Each Entry receives a unique Ticket Number generated by the Competition Platform.

Participant

Means any person who creates an Account and purchases an Entry into a Competition.

Prize

Means the item, vehicle, cash amount, product, service or other benefit offered by RAFFLE-it as the reward for the winning Entry.

Guaranteed Competition

Means a Competition where RAFFLE-it guarantees that the advertised Prize will be awarded regardless of the number of Entries sold.

Ticket Number

Means the unique number automatically generated and allocated to an Entry by the Competition Platform.

Website

Means the official RAFFLE-it Website and all associated digital platforms operated by RAFFLE-it.

Winner

Means the Participant whose Ticket Number has been randomly selected by the Competition Platform as the winning Entry.


1.2 Interpretation

Unless the context indicates otherwise:

  • Words referring to one gender include all genders.
  • Words referring to the singular include the plural and vice versa.
  • Headings are included for convenience only and do not affect interpretation.
  • Any reference to legislation includes amendments, replacements and regulations made under such legislation.
  • The words “including” and “includes” shall not limit the meaning of any preceding words.

2. Introduction and Acceptance of Terms

2.1

These Official Competition Terms & Conditions govern all Competitions conducted by RAFFLE-it.

2.2

By creating an Account, purchasing an Entry, accessing the Website or participating in any Competition, the Participant confirms that they:

  • Have read and understood these Terms and Conditions.
  • Agree to be legally bound by them.
  • Confirm that all information supplied is accurate and truthful.
  • Agree to comply with all Competition rules published by RAFFLE-it.

2.3

If a Participant does not agree with these Terms and Conditions, they must not:

  • Create an Account.
  • Purchase an Entry.
  • Participate in any Competition.
  • Use any services provided by RAFFLE-it.

2.4

These Terms and Conditions apply together with any specific Competition rules displayed on the relevant Competition page.

Where a specific Competition rule applies, that rule shall supplement these Terms and Conditions.


3. RAFFLE-it Fairness Commitment

3.1 Transparency Commitment

RAFFLE-it is committed to conducting all Competitions in a manner that is fair, transparent and accountable.

3.2 Automated Entry Allocation

Each valid paid Entry is automatically allocated a unique Ticket Number by the Competition Platform.

The Ticket Number is permanently associated with the Participant’s Account for that Competition.

3.3 Random Winner Selection

Winner selection is performed using the Competition Platform’s automated random selection process.

No employee, director, shareholder, contractor, supplier or representative of RAFFLE-it has the ability to manually select or influence winning Ticket Numbers.

3.4 Multiple Prize Draws

Where a Competition includes multiple Prizes:

  • The first selected valid Ticket Number shall represent the first Prize.
  • Additional valid Ticket Numbers shall be randomly selected for additional Prizes.
  • Unless otherwise stated, the same Participant may not win more than one Prize in the same Competition.

3.5 Live Draws

Where stated, RAFFLE-it may livestream Competition draws through official RAFFLE-it channels.

Livestreaming is intended to provide additional transparency and confidence to Participants.

4. Eligibility Requirements

4.1 Minimum Age

Participation is strictly limited to persons aged eighteen (18) years or older.

4.2 South African Participation

Unless otherwise stated, Competitions are open only to residents of the Republic of South Africa.

4.3 Legal Capacity

Participants confirm that they have the legal capacity to enter into a binding agreement.

4.4 Excluded Persons

The following persons may not participate:

  • Employees of RAFFLE-it
  • Directors, shareholders or owners of RAFFLE-it
  • Contractors or representatives directly involved in operating a Competition
  • Immediate family members of excluded persons where such participation may create an unfair advantage

4.5 Verification

RAFFLE-it reserves the right to request proof of:

  • Identity
  • Age
  • Residence
  • Payment ownership

before awarding any Prize.


5. User Registration and Accounts

5.1 Account Requirement

A Participant must create and maintain a valid Account before purchasing any Entry into a Competition.

All Entries purchased through RAFFLE-it must be linked to a registered Account.


5.2 Accurate Information

Participants are responsible for ensuring that all information provided during registration is:

  • Accurate
  • Current
  • Complete
  • Not misleading

This includes, but is not limited to:

  • Full legal name
  • Identity details
  • Contact number
  • Email address
  • Residential address
  • Payment information where required

5.3 Account Security

Participants are responsible for maintaining the confidentiality of their Account login details.

Participants must immediately notify RAFFLE-it if they believe:

  • Their Account has been accessed without permission
  • Their password or login information has been compromised
  • Their personal information has been misused

RAFFLE-it shall not be responsible for losses arising from a Participant’s failure to protect their Account credentials.


5.4 One Personal Account

Each Participant may only create and operate an Account in their own legal name.

Participants may not:

  • Create Accounts using false identities
  • Create Accounts on behalf of another person
  • Use another person’s Account
  • Attempt to bypass Competition restrictions through multiple fraudulent Accounts

5.5 Account Verification

RAFFLE-it reserves the right to verify Account information at any time.

Verification may include requesting:

  • South African Identity Document
  • Driver’s Licence
  • Proof of address
  • Proof of payment ownership
  • Any other reasonable documentation required to confirm eligibility

5.6 Suspension or Closure of Accounts

RAFFLE-it reserves the right to suspend, restrict or terminate an Account where:

  • False information has been provided
  • Fraudulent activity is suspected
  • These Terms and Conditions have been breached
  • The Account has been used unlawfully
  • The security or integrity of the Website or Competition Platform may be compromised

Where reasonably possible, RAFFLE-it will provide notice of suspension or termination.


5.7 Account Ownership

An Account belongs exclusively to the registered Participant.

Entries, Tickets and Prizes cannot be transferred, sold, assigned or given to another person unless expressly authorised by RAFFLE-it in writing.


6. Competition Entries and Ticket Allocation

6.1 Purchasing Entries

Participants may purchase Entries into available Competitions through the RAFFLE-it Website.

An Entry is only valid once:

  • Payment has been successfully completed
  • Payment has been confirmed by the applicable payment provider
  • The Entry has been recorded by the Competition Platform

6.2 Automatic Ticket Number Generation

Upon successful purchase of an Entry:

  • The Competition Platform automatically generates a unique Ticket Number
  • The Ticket Number is linked to the Participant’s Account
  • The Ticket Number is recorded against the specific Competition entered

RAFFLE-it does not manually allocate winning numbers.


6.3 Ticket Ownership

A Ticket Number represents the Participant’s valid Entry into a specific Competition.

Ticket Numbers:

  • Cannot be selected by Participants
  • Cannot be exchanged
  • Cannot be transferred
  • Cannot be duplicated within the same Competition

6.4 Multiple Entries

Unless otherwise stated for a specific Competition, Participants may purchase unlimited Entries.

Each additional valid Entry increases the Participant’s number of Ticket Numbers allocated within that Competition.


6.5 Entry Confirmation

Participants may view their purchased Entries and allocated Ticket Numbers through their Account.

Participants are responsible for ensuring that confirmation emails and Account details are accurate.


6.6 Invalid Entries

RAFFLE-it reserves the right to cancel any Entry which:

  • Was purchased fraudulently
  • Was obtained through unlawful means
  • Was affected by a payment reversal
  • Was created through a technical error
  • Breaches these Terms and Conditions

6.7 FREE ENTRY ROUTE

A Participant with a valid Account may enter any of the raffles offered by RAFFLE-it through the FREE ENTRY ROUTE.

The FREE ENTRY ROUTE option is available on the Website for each raffle.

The FREE ENTRY ROUTE is available via the South African Postal Service to the relevant postal address of RAFFLE-it.

The FREE ENTRY ROUTE must reach RAFFLE-it at least three (3) days prior to the closing date of the applicable raffle or competition.

One FREE ENTRY ROUTE entry is permitted for each Account holder for each raffle or competition.

The FREE ENTRY ROUTE entry must be sent on a stamped postcard, clearly indicating the raffle or competition being entered, addressed to RAFFLE-it, and mailed to the P.O. Box number published on the RAFFLE-it Website.


7. Payment Terms

7.1 Accepted Payment Methods

RAFFLE-it may accept various payment methods, including:

  • Credit cards
  • Debit cards
  • Electronic Funds Transfer (EFT)
  • Apple Pay
  • Google Pay
  • Other approved payment methods displayed on the Website

7.2 Payment Processing

Payments may be processed through approved third-party payment providers.

RAFFLE-it does not store complete payment card details unless permitted and required for secure payment processing.

7.3 Successful Payment Requirement

An Entry only becomes valid after payment has been successfully authorised and confirmed.

A Participant may not rely solely on:

  • A pending transaction
  • A failed payment attempt
  • A bank instruction that has not cleared

7.4 Payment Errors

Where a payment error occurs, including:

  • Duplicate payments
  • Incorrect amounts
  • Failed transactions

RAFFLE-it will investigate the matter and take reasonable steps to resolve the issue.

7.5 Payment Fraud

RAFFLE-it reserves the right to cancel Entries and suspend Accounts where payment fraud is suspected.

This includes:

  • Use of stolen payment information
  • Unauthorised transactions
  • False payment confirmations
  • Manipulation of payment systems

7.6 Payment Provider Delays

RAFFLE-it is not responsible for delays caused by:

  • Banks
  • Payment processors
  • Internet service providers
  • Technical interruptions outside RAFFLE-it’s control

8. Competition Categories

8.1 Competition Information

Each Competition page will display relevant information, including:

  • Competition name
  • Prize details
  • Entry cost
  • Draw Date
  • Closing date
  • Competition type
  • Any special rules applicable

Participants are responsible for reviewing Competition information before purchasing Entries.


8.2 Guaranteed Competitions

A Guaranteed Competition is a Competition where RAFFLE-it guarantees that the advertised Prize will be awarded.

The Winner will receive the advertised Prize regardless of the number of Entries sold.


8.3 Conditional Competitions

A Conditional Competition is a Competition where the advertised Prize may depend on achieving a stated minimum Entry requirement.

The Competition page will clearly disclose:

  • That the Competition is Conditional
  • The required Entry target, where applicable
  • The alternative Prize arrangement should the target not be achieved

Participants acknowledge and accept these conditions before purchasing an Entry.


8.4 Prize Description

RAFFLE-it will make reasonable efforts to ensure that Prize descriptions are accurate.

Minor variations in appearance, colour, specification or availability may occur where reasonably necessary.

Where a Prize is described by a specific make, model or specification, RAFFLE-it will endeavour to provide that Prize or the stated equivalent.


9. Competition Draw Process

9.1 Published Draw Information

Each Competition will display:

  • Competition closing date
  • Draw Date
  • The applicable Prize or Prizes
  • The Competition type (Guaranteed or Conditional)
  • Any additional Competition-specific rules

Participants acknowledge that they are responsible for reviewing this information before purchasing Entries.


9.2 Fixed Draw Dates

RAFFLE-it commits to conducting draws on the advertised Draw Date.

Draw Dates will not be changed except in circumstances beyond RAFFLE-it’s reasonable control, including but not limited to:

  • Major technical failures
  • Legal or regulatory requirements
  • Events making the draw impossible or unlawful

Where a Draw Date must be changed, RAFFLE-it will communicate the reason and provide an updated draw schedule.


9.3 Closing of Entries

Once a Competition closes:

  • No further Entries will be accepted
  • The final list of valid Ticket Numbers will be locked
  • The Competition Platform will proceed with the random selection process

RAFFLE-it reserves the right to exclude invalid Entries before the draw takes place.


9.4 Random Winner Selection

Winning Ticket Numbers shall be selected through the Competition Platform’s automated random selection function.

The selection process:

  • Includes all valid Entries recorded for that Competition
  • Does not allow manual selection of Winners
  • Is not influenced by RAFFLE-it employees or representatives

The random selection result generated by the Competition Platform shall be considered final, subject to verification of the Winner’s eligibility.


9.5 Multiple Prize Competitions

Where a Competition contains multiple Prizes:

  • The first randomly selected valid Ticket Number will be allocated the first Prize
  • The second randomly selected valid Ticket Number will be allocated the second Prize
  • The third randomly selected valid Ticket Number will be allocated the third Prize
  • This process will continue until all advertised Prizes have been allocated

Unless otherwise stated, a Participant may not win multiple Prizes within the same Competition.


9.6 Draw Transparency

RAFFLE-it may provide transparency through:

  • Live-streamed draws
  • Recorded draw videos
  • Published Winner announcements
  • Prize presentation content

RAFFLE-it reserves the right to determine the appropriate format and platform for publishing draw content.


10. Winner Selection and Verification

10.1 Provisional Winner Status

A selected Ticket Number represents a provisional Winner only until verification has been completed.

A Prize will only be released once RAFFLE-it has confirmed:

  • The validity of the Entry
  • The Participant’s identity
  • The Participant’s eligibility
  • Compliance with these Terms and Conditions

10.2 Winner Identification

The Winner must provide valid identification.

Acceptable identification may include:

  • South African Identity Document
  • Valid Driver’s Licence
  • Passport where accepted by RAFFLE-it

10.3 Additional Verification

RAFFLE-it may request additional information where reasonably required, including:

  • Proof of residential address
  • Proof that the payment method belongs to the Participant
  • Additional documentation relating to Prize delivery

10.4 Failure to Verify

If a selected Winner:

  • Cannot prove eligibility
  • Provided false information
  • Used fraudulent payment methods
  • Breached these Terms and Conditions

RAFFLE-it may disqualify that Winner.

Where necessary, another valid Ticket Number may be selected.


11. Prize Claims

11.1 Winner Notification

RAFFLE-it will attempt to contact Winners using the details registered on their Account.

Communication may occur through:

  • Email
  • Telephone
  • SMS
  • Other official communication channels

11.2 Claim Period

A Winner must claim their Prize within seven (7) calendar days from the date of notification.


11.3 Delayed Claims

If a Winner cannot complete the claim process within seven (7) days due to reasonable circumstances, they must notify RAFFLE-it before the expiry of the claim period.

RAFFLE-it may, at its discretion, approve additional time arrangements.

Any storage, insurance or additional costs arising from delayed collection may be the responsibility of the Winner.


11.4 Failure to Claim

If a Winner fails to:

  • Respond within the required period
  • Provide the required verification
  • Complete the claim process

RAFFLE-it reserves the right to treat the Prize as unclaimed.

Further action regarding unclaimed Prizes will be determined by RAFFLE-it in accordance with applicable law.


12. Prize Delivery and Collection

12.1 Collection Option

Where available, Winners may collect their Prize from a nominated RAFFLE-it collection point.

Collection arrangements must be agreed with RAFFLE-it before collection.


12.2 Delivery Arrangements

Where delivery is requested:

  • Delivery costs are the responsibility of the Winner unless otherwise stated
  • The Winner must provide accurate delivery information
  • Delivery arrangements must be approved by RAFFLE-it

12.3 Delivery Risk

Once a Prize has:

  • Been collected by the Winner; or
  • Been handed to an agreed courier service,

RAFFLE-it will not be responsible for loss or damage occurring after that point.


12.4 Vehicle Prizes

Where a Prize involves a motor vehicle, the Winner acknowledges that they are responsible for:

  • Registration costs
  • Licensing fees
  • Insurance
  • Transfer fees
  • Ongoing ownership costs

unless otherwise specifically stated.

13. Cash Alternatives

13.1 Availability

Certain Competitions may offer a cash alternative instead of the advertised Prize.

The availability of a cash alternative will always be clearly displayed before Entries are purchased.


13.2 No Automatic Cash Alternative

Unless a cash alternative is specifically advertised:

  • The Winner must accept the advertised Prize.
  • RAFFLE-it is not required to provide a cash substitute.

13.3 Cash Alternative Amount

Where offered, the cash alternative amount will be the amount stated on the Competition page.

The Winner may not negotiate a different cash amount.


14. Publicity and Marketing Consent

14.1 Importance of Winner Verification

RAFFLE-it believes that transparency and real Winner experiences are important to maintaining trust with Participants.

For this reason, Winners may be invited to participate in promotional activities relating to their Prize.


14.2 Winner Publicity Permission

By entering a Competition, Participants agree that if they become a Winner, RAFFLE-it may use:

  • Their name
  • Their photograph
  • Their video recording
  • Their voice
  • Their interview
  • Their general location (city/suburb only)
  • Prize presentation footage

for marketing and promotional purposes.


14.3 Purpose of Publicity

Publicity may be used for:

  • Website content
  • Social media
  • Advertising campaigns
  • Promotional videos
  • Public announcements
  • Future Competition marketing

14.4 No Additional Compensation

The Winner acknowledges that promotional use of their approved publicity material does not create any entitlement to additional payment.


14.5 Consent and Privacy

RAFFLE-it will process personal information in accordance with its Privacy Policy and applicable South African privacy legislation, including POPIA.


15. Fraud Prevention and Disqualification

15.1 Fair Participation

RAFFLE-it is committed to ensuring that all Participants have an equal opportunity to participate in Competitions conducted through the Website.

Any attempt to gain an unfair advantage, interfere with Competition processes, or compromise the integrity of a Competition may result in immediate action being taken.


15.2 Prohibited Conduct

Participants may not:

  • Create false Accounts
  • Use another person’s identity
  • Use stolen or unauthorised payment methods
  • Manipulate, interfere with, or attempt to access the Competition Platform unlawfully
  • Exploit technical errors or system failures
  • Engage in fraudulent activity
  • Attempt to influence draw outcomes
  • Abuse promotional offers
  • Use automated systems, bots or software intended to unfairly purchase Entries

15.3 Investigation Rights

RAFFLE-it reserves the right to investigate any activity which it reasonably believes may:

  • Breach these Terms and Conditions
  • Affect the fairness of a Competition
  • Constitute fraud or unlawful conduct

During an investigation, RAFFLE-it may temporarily suspend an Account or delay Prize release.


15.4 Disqualification

RAFFLE-it may cancel Entries and disqualify a Participant where:

  • The Participant has breached these Terms and Conditions
  • The Entry was obtained fraudulently
  • The Participant provided false information
  • The Participant is not legally eligible
  • The Participant has attempted to compromise the Competition

15.5 Reporting Criminal Activity

Where RAFFLE-it suspects criminal conduct, it reserves the right to report the matter to the relevant authorities.


16. Chargebacks and Payment Reversals

16.1 Chargeback Definition

A chargeback occurs where a Participant requests their bank, card provider or payment provider to reverse a payment after an Entry has been issued.


16.2 Responsibility for Payments

By purchasing an Entry, the Participant confirms that:

  • They are authorised to use the selected payment method
  • The payment information provided is accurate
  • The transaction is legitimate

16.3 Invalid Chargebacks

A Participant may not use a chargeback process to unfairly obtain Entries and later reverse payment.

Where a chargeback is received after Entries have been issued, RAFFLE-it reserves the right to:

  • Suspend the Account
  • Cancel affected Entries
  • Recover any outstanding amounts
  • Withhold Prizes until the matter is resolved

16.4 Fraudulent Payment Reversals

Any intentional attempt to obtain Entries without completing payment may be treated as fraudulent conduct.


17. Refund Policy

17.1 General Rule

Due to the nature of Competition Entries, Entries are generally non-refundable once payment has been successfully processed and Ticket Numbers have been allocated.


17.2 Exceptions

Refund requests may be considered where:

  • A duplicate payment occurred
  • A technical payment error occurred
  • A payment was incorrectly processed
  • A refund is required by applicable law

17.3 Refund Process

Where a refund is approved:

  • The refund will be processed using the original payment method where possible
  • Processing times may vary depending on banking providers
  • RAFFLE-it may request additional verification before processing

18. Website Operation and Technical Issues

18.1 Website Availability

RAFFLE-it will make reasonable efforts to maintain Website availability.

However, uninterrupted access cannot be guaranteed.


18.2 Technical Failures

RAFFLE-it shall not be responsible for interruptions caused by:

  • Internet failures
  • Hosting failures
  • Payment provider failures
  • Software failures
  • Cybersecurity incidents
  • Events outside RAFFLE-it’s reasonable control

18.3 System Errors

If a technical error affects:

  • Ticket allocation
  • Payment processing
  • Competition operation

RAFFLE-it reserves the right to investigate and take reasonable corrective action.

This may include correcting errors, cancelling affected Entries, or postponing action where necessary to protect fairness.

19. Force Majeure

19.1 Definition

Force Majeure means circumstances beyond the reasonable control of RAFFLE-it which prevent or significantly affect the operation of a Competition.


19.2 Examples

Force Majeure events may include:

  • Natural disasters
  • Power failures
  • Internet infrastructure failures
  • Government restrictions
  • Civil unrest
  • Cyber attacks
  • Acts of God
  • Other unforeseeable events

19.3 Effect of Force Majeure

Where a Force Majeure event occurs, RAFFLE-it may take reasonable steps to protect Participants and maintain Competition fairness.


20. Intellectual Property

20.1 Ownership

All content appearing on the RAFFLE-it Website, including:

  • Logos
  • Branding
  • Graphics
  • Text
  • Software
  • Designs

belongs to RAFFLE-it or its authorised licensors.


20.2 Restrictions

Participants may not:

  • Copy RAFFLE-it branding
  • Reproduce Website content
  • Use RAFFLE-it intellectual property without prior written permission

21. Electronic Communications

21.1 Electronic Agreement

Participants acknowledge that electronic communication is a valid method of communication between RAFFLE-it and Participants.


21.2 Notices

RAFFLE-it may communicate with Participants through:

  • Email
  • SMS
  • Website notices
  • Official social media channels

22. Privacy and Personal Information Protection

22.1 Protection of Information

RAFFLE-it respects Participant privacy and will handle personal information responsibly.


22.2 Personal Information Use

Personal information may be used for:

  • Creating Accounts
  • Processing Entries
  • Conducting Competitions
  • Verifying Winners
  • Communicating with Participants
  • Marketing where consent has been obtained

22.3 POPIA Compliance

RAFFLE-it will process personal information in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act (POPIA).


23. Limitation of Liability

23.1 Reasonable Limitation

To the maximum extent permitted by South African law, RAFFLE-it shall not be liable for losses arising from circumstances outside its reasonable control.


23.2 No Exclusion of Legal Rights

Nothing in these Terms excludes any consumer rights or legal protections which cannot lawfully be excluded.


24. Indemnity

24.1 Participant Responsibility

Participants agree to indemnify RAFFLE-it against losses arising from:

  • Fraudulent activity
  • Breach of these Terms and Conditions
  • Unlawful use of the Website
  • False information provided by the Participant

25. Amendments to Terms

25.1 Updates

RAFFLE-it reserves the right to update these Terms and Conditions where reasonably necessary.


25.2 Existing Competitions

Changes will not unfairly affect Competitions already completed or Entries already purchased unless required by law.


26. General Legal Provisions

26.1 Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.


26.2 Entire Agreement

These Terms and Conditions, together with any Competition-specific rules, represent the complete agreement between RAFFLE-it and Participants relating to Competitions.


26.3 Waiver
